About a month ago our fellow Avenuer Reinsey let us know that our block was also being effected by this "overlay" that is apparently in relation to a flood/water related issue, i contacted my CSC about it to find out what would be the process and weather it would effect our block and this morning i received my answer, It was a big fat YES, Not only do we know have to apply for a planning overlay through the council we will also occur cost and could have a 12-16 week wait till we can build :( which to make it 10 times worse it also means that we will go over our time that we have to start building with Metricon and will occur cost there too.
Reinsey what was the process for you guys and are you going to have to wait this 12-16 week period???

First question... Did you guys fix ur site costs? If so, you shouldn't have to pay any extra.
Carlisle were totally on top of this and ordered a new level survey straight away. They then submitted a new set of plans with the levels included to council, they paid the application fee and we were assigned a case manager at council pre Xmas. Carlisle are on a break until Jan 10th, so I don't know anything more at this stage. Ezzmay is in stage 9, building with Carlisle and also had the overlay and only had a 3 to 4 week delay. So it mightn't end up being too bad :)
Hey Reinsey, yes we have fixed our site cost but for some reason this is not considered to be under it for metricon, so it is upto us to do it :(, they are how ever re-doing our plans to include this overlay into our plans so we can submit the new ones with our planning permit, its the casey council that are telling us that it will be a 12-16 week wait once we submit our application.I hope to god that it is only a 3-4 week delay then it would still be before our settlement date which i forgot to metion has been pushed out to Feb :/ hmmmm this is all so stressful..
Check your contract Tash. There may be something in the site costs about all permit fees being included. Are they making you do the whole application for the planning permit?
Who did you speak to at Council? Maybe it was someone who doesn't really know what's going on, coz they would have had a few of these to deal with by now.
Could also be worth private messaging Emilio from the forum too. He's had to apply for his own and may have more info than I do coz our builder has handled it all.
At least Metricon are onto it now, rather than waiting until after the land settles.
I will check my contract!! Yes we are doing the whole application which is a little more difficult when the title is not in our name yet, but it is still do able, which is better then not i guess.
The lady (Roslin) i spoke to at the council did seem to know all about the situation but didnt no anyone was building on the overlay yet tho so i may bring this up to her!! And if i can work out how to pm someone on the forum i will definatly get in contact with emilio to see how they have gone about it.

Tash to pm you just need to log in to the forum the same way you would if you were going to post. Then you can either do a search for Emilio ( I think his user name is emilo?) or find a post that he has made, and in the bottom corner there's a little pm button.
There's already 1 house in stage 9 that's under construction + 4 others with permits pending; us, Emilio, Kerry and our neighbour on the left who we don't know yet.
There was talk of the overlay being lifted. It was only supposed to be there to make sure the developer dealt with the old aggricultural drain, which the roads and infrastructure in the estate have achieved.
I'll ring the council and see what I can find out for you...

Spoke to Helen at Casey council. Ours should be through early next week. They are just waiting on info from their drainage department. She said these applications are pretty straightforward and certainly don't take 16 weeks.
Have metricon ordered a levels survey for you guys yet? They wouldn't normally do this but it's needed to accompany the application to council.
Emilio is such a great guy, he'll probably walk you through the process step by step.
